Increased Flexibility for Work Visa Holders: Key Changes Coming in 2024
Starting 1 July 2024, Australia is set to introduce significant updates to visa conditions that will offer greater flexibility for temporary work visa holders. These changes are part of the Australian Government’s ongoing efforts to combat worker exploitation and improve productivity across various industries.

Which Visas Are Affected?
The changes will apply to the following visas:
- Temporary Work (Skilled) visa (Subclass 457)
- Temporary Skill Shortage visa (Subclass 482)

What’s New?
Starting from 1 July 2024, visa holders who stop working for their sponsor will have up to 180 days at a time (or a maximum of 365 days across the entire visa period) to find a new sponsor or arrange other visa options. This is a significant increase from the current limit of 60 consecutive days.
During these extended periods, visa holders are allowed to work for other employers, including in occupations different from those listed on their most recent nomination. However, it is crucial that any work undertaken aligns with the licenses or registration required for the visa holder’s nominated occupation.
These updates apply to both existing visa holders and those who will be granted a visa from 1 July 2024 onwards. Importantly, any days not working before this date will not count towards the new 365-day limit.
What’s Next? Upcoming Changes in November 2024
In addition to the changes effective from 1 July, the Government has also announced plans to simplify the Temporary Skill Shortage (TSS) visa process starting from 23 November 2024.
Under the current regulations, Subclass 482 TSS visa applicants must have two years of full-time work experience in their occupation or a related field. However, the new changes propose reducing this requirement to just one year.
It’s important to note that if you do not have a formal qualification, you may still need to compensate with additional work experience. The exact amount of additional experience required can vary based on several factors, including your qualifications, the skill level of the position, and the recency of your work experience.
This proposed change is still subject to approval by Parliament but represents a positive development for those planning to apply for a TSS visa in late 2024.
